Terms of Service

01 Acceptance of Terms +

By creating an account, accessing, or using Badlands (the "Server"), you agree to be bound by these Terms of Service (the "Terms") and our Privacy Policy, as well as any rules posted in a specific channel or feature of the Server. If you do not agree, you must discontinue use immediately.

02 Private Service / No Entitlement +

Badlands is a privately operated Fluxer server. The operator reserves the right to modify, restrict, suspend, or permanently terminate any account, service, or content at any time, for any reason, with or without notice.

Users have no ownership interest or entitlement to continued access, usernames, or stored data. If you are a Premium subscriber and the operator ends your access without a violation of these Terms, see the refund terms in Section 17.

03 Eligibility +

Use of this Server is restricted to individuals 18 years of age or older. By using the Server you confirm that you are at least 18. Any account identified as belonging to a minor will be terminated immediately.

Some channels or areas of the Server may prompt you to enter a date of birth to confirm you meet additional age requirements for that content. This information is used solely to gate access to age-restricted areas and is not sold, shared with third parties, or used for any other purpose.

Badlands is operated from the United States and is intended for users located in the United States. If you access the Server from elsewhere, you are responsible for complying with the laws that apply to you.

04 Your Account +

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You must provide accurate registration information, including a valid email address, and keep it up to date.

If you become aware of unauthorised access to your account, contact the operator promptly at admin@badlands.chat. Use a strong, unique password and enable two-factor authentication where available. If you find a security vulnerability in the Server, please report it to the same address rather than publicly disclosing or exploiting it.

05 Acceptable Use +

You agree not to use the Server to:

  • Violate any applicable law or regulation
  • Post, share, or request sexual content involving minors, or sexualise minors in any way (see Section 06)
  • Post sexually explicit or pornographic images, video, or audio. Age-gated channels may host mature themes and discussion, but not sexually explicit media
  • Share, or threaten to share, intimate images of any person without their consent
  • Threaten, incite, or glorify violence, or promote terrorism or violent extremism
  • Harass, stalk, or target any person, including by publishing their private information (doxxing)
  • Transmit unlawful, harmful, defamatory, or abusive content
  • Encourage or promote suicide or self-harm
  • Offer or solicit illegal goods or services, or run scams or other fraud
  • Distribute malware, spam, phishing attempts, or conduct network abuse
  • Attempt unauthorised access to systems, accounts, or infrastructure
  • Interfere with or disrupt service stability
  • Run bots, self-bots, scrapers, or other automated tools against the Server or its API unless the operator has approved them
  • Evade a ban, suspension, or other restriction, including by creating a new account
  • Sell, trade, or transfer accounts or usernames
  • Infringe the intellectual property or other rights of any person or entity
  • Impersonate any person, entity, or organisation

Rules posted for a specific channel apply in addition to this section.

06 Illegal Content & Mandatory Reporting +

There is zero tolerance for child sexual abuse material (CSAM) or any sexualised depiction of minors. If the operator becomes aware of such material, it will be removed, the account will be permanently terminated, and the material and related account information will be preserved and reported to the National Center for Missing & Exploited Children (NCMEC) as required by 18 U.S.C. § 2258A, and may be provided to law enforcement.

The operator may also report other apparent serious illegal activity, such as credible threats of violence, to law enforcement as described in the Privacy Policy.

07 Moderation, Reports & Appeals +

The operator may remove content and restrict, suspend, or terminate accounts that violate these Terms or that the operator reasonably believes pose a risk to the Server or its users. The operator is not obligated to monitor content, and the absence of action on a particular item does not mean it is allowed.

Reporting content. You can report a message using the report option in the app, or email admin@badlands.chat with a link to or description of the content. Reports are reviewed by a person. Sexually explicit media (Section 05) and other content that violates these Terms will be removed when the operator becomes aware of it. Knowingly false or abusive reports may result in action against the reporting account.

Intimate images shared without consent. If an intimate image or video of you, including one that has been digitally altered or generated, was shared on the Server without your consent, you can ask for it to be removed. Use the in-app report option or email admin@badlands.chat with the subject "Intimate image removal" and include: (1) your physical or electronic signature, or that of a person authorised to act for you; (2) identification of the image and information reasonably sufficient to locate it, such as a link to the message (please do not send the image itself); (3) a brief statement that you have a good-faith belief that it was shared without your consent; and (4) your contact information. The operator will remove the image within 48 hours of receiving a valid request and will make reasonable efforts to find and remove identical copies on the Server.

Where practical, the operator will tell you by email what action was taken and why. Notice may be delayed or withheld where it would compromise an investigation, put someone at risk, or conflict with a legal obligation.

If you believe an action was a mistake, you may appeal by emailing admin@badlands.chat from the email address on the affected account within 30 days of the action, explaining why you think it was wrong. Appeals are reviewed by a person. The operator will consider appeals in good faith but is not obliged to reverse a decision, and measures normally stay in place while an appeal is reviewed. This section does not limit the operator's discretion described in Section 02.

08 Your Content +

You retain ownership of content you create and share on the Server. By submitting content, you grant the operator a limited, non-exclusive, royalty-free licence to store, host, transmit, display, and technically adapt it (for example, compressing or resizing media so it works across devices) solely for the purpose of delivering the service to you and the people you share it with. This licence extends to the operator's hosting and infrastructure providers only so far as needed to run the Server.

The licence for a piece of content ends when you delete it, subject to the limited retention described in the Privacy Policy (for example, backups), and except for copies that other users have already made or quoted.

You are solely responsible for all content you transmit and for ensuring you have the necessary rights to share it. The operator is not obligated to monitor, screen, or moderate content, but reserves the right to remove any content at any time.

Your content will never be used for advertising, AI training, or any purpose beyond operating the Server.

09 Email Address & Communications +

An email address is required to register an account. Your email is used exclusively for:

  • Password resets and account recovery
  • Security alerts and administrative notices (including moderation notices)
  • Billing receipts and notices, if you subscribe to Premium
  • Material changes to these Terms or the Privacy Policy

Your email address is never sold, shared with third parties (other than the email delivery provider that sends these messages), or used for marketing. See the Privacy Policy for full details on how it is handled and retained.

10 Date of Birth (Age-Gated Channels) +

The Server may ask for a date of birth before access to certain channels is granted. This information is used solely to confirm you meet the minimum age requirement for that content area.

Date of birth data is:

  • Not sold to, shared with, or disclosed to any third party
  • Not used for profiling, advertising, or any purpose other than the above age check
  • Not independently verified - you are responsible for providing accurate information

Providing a false date of birth to bypass age restrictions is a violation of these Terms and may result in immediate account termination.

11 Server Logs & Data Retention +

The Server generates logs for operational, debugging, and security purposes. The Privacy Policy (Section 07) sets out what is kept and for how long. In summary:

  • Server logs are rotated and kept for a limited period
  • Message content, account data, device identifiers, and metadata are retained until you delete the content or your account is deleted (messages you sent are not automatically deleted when you close your account; see Section 15)
  • Email addresses are retained for the lifetime of your account and purged upon verified account deletion
  • Date of birth entries are retained for the lifetime of your account
  • Deleted data may remain in encrypted backups for a limited time, and some records (for example billing records) are kept as long as the law requires
12 Service Availability +

The Server is provided "as is" and "as available". The operator makes no guarantees regarding uptime, reliability, message delivery, or data retention. Outages, maintenance windows, and feature changes may occur at any time, and features may be added, changed, or removed.

The Server is not designed for safety-critical use. Do not rely on it for emergency communications or in any situation where a delay or outage could cause injury or serious harm.

13 Limitation of Liability +

To the fullest extent permitted by applicable law, the operator is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, communications, profits, or goodwill, arising from your use of the Server, including service interruption.

The operator's total liability for all claims relating to the Server or these Terms is limited to the greater of $50 USD or the amount you paid the operator in the 12 months before the claim arose.

Some jurisdictions do not allow certain limitations. In those cases, the limits above apply to the maximum extent allowed, and nothing in these Terms excludes liability that cannot be excluded by law.

14 Indemnification +

To the extent permitted by law, you agree to indemnify and hold harmless the operator from third-party claims, and resulting damages and reasonable expenses, arising from your content, your use of the Server, or your violation of these Terms.

15 Termination & Data on Account Closure +

You may stop using the Server and delete your account at any time, as described in the Privacy Policy (Section 08). The operator retains the right to suspend or permanently terminate any account or service at any time, for any reason, without prior notice, subject to Section 17 for Premium subscribers.

Upon account deactivation or deletion, whether user-initiated or operator-initiated, locally stored account data, including your email address and date of birth, will be removed from this server (subject to backup and legal retention periods in the Privacy Policy). Messages you have sent are not automatically deleted and may remain visible to other users unless you delete them before account closure. You may also email the operator to ask for deletion of your messages, and the operator will make reasonable efforts to do so.

Accounts with no sign-in for 24 months may be deleted after 30 days' notice to the registered email address.

Sections that by their nature should survive termination (including content licences already granted for retained copies, limitation of liability, indemnification, and governing law) will survive.

16 User-Caused Security Incidents +

The operator is not responsible for any loss, disclosure, or compromise of account information or messages caused by user actions or negligence, including but not limited to:

  • Sharing login credentials or device access
  • Using insecure devices or networks
  • Failing to apply client-side security updates
  • Phishing, malware, or other exploits targeting the user

Users are solely responsible for safeguarding their accounts and access information.

17 Premium Subscriptions & Payments +

Badlands offers an optional paid Premium subscription, purchased on the platform. Premium is not required to use the Server and is governed by these Terms in addition to the terms below.

Pricing & features. Premium pricing and the features included with it are set out at checkout. Prices exclude applicable taxes unless stated; where tax applies it is shown at checkout. Features and prices may change. If the price of your existing subscription is going to increase, the operator will email you at least 30 days before the new price applies to your next renewal, and you may cancel before then. Price decreases and promotions apply when posted.

Payment processing. All payments are processed by Stripe, a third-party payment processor. The operator does not collect or store your full card number, CVV, or other full payment credentials (see Section 16 of the Privacy Policy for what is and isn't held). Use of Stripe's checkout is also subject to Stripe's Terms of Service and Stripe's Privacy Policy.

Billing & renewal. Premium subscriptions renew automatically (monthly or yearly, as selected at checkout) until cancelled. You can cancel at any time through the subscription portal. Cancellation takes effect at the end of the current billing period, and you keep Premium until then. A receipt is emailed after each charge.

Refunds. All sales are final. Refunds are not prorated, and charges are not refunded for partial billing periods, unused time, or after cancellation. When you cancel, Premium stays active until the end of your current billing period and then ends. The only exceptions are duplicate, erroneous, or unauthorised charges, and any refund required by law. The operator may also grant refunds at its discretion.

Other rights. Badlands is directed to users in the United States. This section does not limit any consumer rights that cannot be waived under the law of the place where you live.

Failed payments & disputes. If a renewal payment fails, Stripe may retry the charge automatically before Premium is suspended. You can always dispute a charge with your bank or card issuer, but please raise genuine billing errors with the operator first at admin@badlands.chat, and they will be handled promptly. Filing a chargeback in bad faith against a legitimate charge is a violation of these Terms and may result in account and Premium termination, in addition to any other action the operator takes.

What Premium includes. Premium grants the functional account perks described at checkout (upload limits, voice message length, server join cap, and similar). It also displays a cosmetic Premium badge on your profile. The badge display is a best-effort visual feature, not a core part of the subscription. It may change, be temporarily unavailable, or stop displaying without entitling you to a refund or credit, provided the underlying functional perks remain in effect.

Revocation. Premium access, including the badge, may be revoked for violations of these Terms (see Sections 05 to 07) without refund, in addition to any other action the operator takes against the account. If the operator ends your access for any other reason, no further charges will be made, and the refund terms above still apply (no prorated refunds).

18 Copyright & DMCA +

The operator responds to notices of alleged copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512). Send notices to the operator's designated agent:

Takedown notice. A notice must include: (1) a physical or electronic signature of the copyright owner or a person authorised to act for them; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the material claimed to be infringing and information reasonably sufficient to locate it on the Server; (4) your name, address, telephone number, and email address; (5) a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law; and (6) a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act for the copyright owner. Knowingly misrepresenting that material is infringing may make you liable for damages under 17 U.S.C. § 512(f).

Counter-notice. If you believe your content was removed by mistake or misidentification, send a counter-notice to the same agent including: (1) your physical or electronic signature; (2) identification of the removed material and where it appeared before removal; (3) a statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification; and (4) your name, address, and telephone number, a statement that you consent to the jurisdiction of the federal district court for the district where you are located (or, if outside the United States, any district where the operator can be found), and that you will accept service of process from the person who sent the original notice. The operator will forward the counter-notice to the complainant and may restore the material in not less than 10 and not more than 14 business days unless the complainant notifies the operator that it has filed a court action.

Accounts of users who are repeat infringers will be terminated in appropriate circumstances.

19 Governing Law & Disputes +

These Terms, and any dispute relating to them or to the Server, are governed by the laws of the State of Texas and applicable US federal law, without regard to conflict-of-law rules.

Before starting any formal proceeding, please email admin@badlands.chat and give the operator 30 days to try to resolve the issue informally. Subject to that step, to either party's right to bring an individual claim in small-claims court, and to any mandatory rules on jurisdiction, the state and federal courts located in Harris County, Texas have exclusive jurisdiction and venue, and you consent to personal jurisdiction there.

Nothing in this section overrides any mandatory consumer protections or non-waivable rights you have under the law of the place where you live.

20 Changes to Terms +

These Terms may be updated from time to time. A change is material if it reduces your rights or adds new obligations or costs for you. Material changes take effect no sooner than 30 days after notice is sent to your registered email address and/or announced in the Server, so you can review them, delete your content, or close your account first. A change may take effect sooner where required by law or needed urgently for security, in which case you will be told as soon as reasonably possible.

Other changes take effect when posted, and the "Last updated" date above shows when. Continued use after a change takes effect constitutes acceptance of the revised Terms.

21 General Terms +
  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and the operator about the Server and replace earlier agreements on the same subject.
  • Severability. If a provision is found unenforceable, it will be limited to the minimum extent necessary and the rest of the Terms stays in effect.
  • No waiver. Failing to enforce a provision is not a waiver of it.
  • Assignment. You may not transfer your rights or obligations under these Terms. The operator may transfer its own, for example as part of a sale or transfer of the Server.
  • Events beyond control. Neither party is liable for failure to perform caused by events beyond its reasonable control, such as outages of internet or power infrastructure, natural disasters, or government action. This does not excuse payment obligations.
  • Notices. The operator may give you notice by email to your registered address or by announcement in the Server. You may give notice to the address in Section 22.
  • No third-party beneficiaries. These Terms do not give rights to anyone other than you and the operator.
