Terms of Service

By creating an account, accessing, or using Badlands (the "Server"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must discontinue use immediately.

Badlands is a privately operated Fluxer server. The operator reserves the right to modify, restrict, suspend, or permanently terminate any account, service, or content at any time, for any reason, with or without notice.

Users have no ownership interest or entitlement to continued access, usernames, or stored data.

Use of this Server is restricted to individuals 18 years of age or older. Any account identified as belonging to a minor will be terminated immediately.

Some channels or areas of the Server may prompt you to enter a date of birth to confirm you meet additional age requirements for that content. This information is used solely to gate access to age-restricted areas and is not sold, shared with third parties, or used for any other purpose.

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You must provide accurate registration information, including a valid email address, and keep it up to date.

If you become aware of unauthorised access to your account, contact the operator promptly at admin@badlands.pw. Use a strong, unique password and enable two-factor authentication where available.

You agree not to use the Server to:

• Violate any applicable law or regulation
• Transmit unlawful, harmful, threatening, defamatory, harassing, or abusive content
• Distribute malware, spam, phishing attempts, or conduct network abuse
• Attempt unauthorised access to systems, accounts, or infrastructure
• Interfere with or disrupt service stability
• Infringe the intellectual property or other rights of any person or entity
• Impersonate any person, entity, or organisation

You retain ownership of content you create and share on the Server. By submitting content, you grant the operator a limited licence to store and transmit it solely for the purpose of delivering the service.

You are solely responsible for all content you transmit and for ensuring you have the necessary rights to share it. The operator is not obligated to monitor, screen, or moderate content, but reserves the right to remove any content at any time.

Your content will never be used for advertising, AI training, or any purpose beyond operating the Server.

An email address is required to register an account. Your email is used exclusively for:

• Password resets and account recovery
• Security alerts and administrative notices
• Material changes to these Terms or the Privacy Policy

Your email address is never sold, shared with third parties, or used for marketing. See the Privacy Policy for full details on how it is handled and retained.

Certain channels may require you to enter a date of birth before access is granted. This information is used solely to confirm you meet the minimum age requirement for that content area.

Date of birth data is:

• Not sold to, shared with, or disclosed to any third party
• Not used for profiling, advertising, or any purpose other than the above age check
• Not independently verified — you are responsible for providing accurate information

Providing a false date of birth to bypass age restrictions is a violation of these Terms and may result in immediate account termination.

The Server generates logs for operational, debugging, and security purposes. By default:

• Server logs are rotated according to configured file size and backup limits
• Message content, account data, device identifiers, and metadata are retained until you delete your account or the content
• Email addresses are retained for the lifetime of your account and purged upon verified account deletion
• Date of birth entries associated with age-gated channels are retained for the lifetime of your account

The Server is provided "as is" and "as available". The operator makes no guarantees regarding uptime, reliability, message delivery, or data retention. Outages, maintenance windows, and feature changes may occur at any time.

To the fullest extent permitted by United States law, the operator shall not be liable for any damages arising from use of the Server, including loss of data, communications, or service interruption. Total liability shall not exceed $50 USD.

You agree to indemnify and hold harmless the operator from any claims, damages, or expenses arising from your use of the Server or violation of these Terms.

The operator retains the exclusive right to suspend or permanently terminate any account or service at any time, for any reason, without prior notice.

Upon account deactivation — whether user-initiated or operator-initiated — locally stored account data, including your email address, may be removed from this server. Messages you have sent may remain visible to other users unless you delete them prior to account closure.

The operator is not responsible for any loss, disclosure, or compromise of account information or messages caused by user actions or negligence, including but not limited to:

• Sharing login credentials or device access
• Using insecure devices or networks
• Failing to apply client-side security updates
• Phishing, malware, or other exploits targeting the user

Users are solely responsible for safeguarding their accounts and access information.

These Terms may be updated at any time. Where changes are material, notice will be provided via email to your registered address and/or via an in-server announcement. Continued use after changes constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the United States. Any disputes shall be resolved under applicable US federal or state law.
